The Madisonville City Council met in a regular council meeting on July 9, 2018 at 6:00 p.m. at 210 W. Cottonwood, Madisonville, Texas

Meeting called to order at 6:00 p.m.
Meeting called to order with the following members present:

I. Mayor Bill Parten called the meeting to order at 6:00 p.m.
II. Invocation was given by Rev. Jim Jackson from Methodist Church
III. Mayor Pro Tem Russell Bailey led the Pledge of Allegiance to the American Flag and the Texas Flag with Mayor Bill Parten and City
Council, staff members and visitors
IV. VISITORS FORUM (3 MINUTES) Terri Davis had concerns if the City Park had rules and regulations about where a citizen can be in the park with out being photographed or bother by a council member. Harry Davis also spoke about his wife’s concerns. The Mayor directed the City Manager to look into the matter.

V. CONSENT AGENDA
All consent agenda items are considered to be routine by the City Council and will be enacted by a motion. There will be no separate discussion on these items unless a Council Member so request, in which event the item will be removed from the Consent Agenda and considered in its normal position on the agenda.

(a.) Approval of the minutes as written for June 11, 2018 and June 29 2018
Council member Lois Brown moved to approve the minutes as written. Seconded by Mayor Pro Tem Russell Bailey with each Council member voted AYE motion carried

(b.) Approval of Accounts Payable as written for the previous month
Mayor Pro Tem Russell Bailey moved to approve the Accounts Payable as written. Seconded by Council member Lois Brown with each Council member voting AYE motion carried
(c.) Discuss and approve the streets to be repaired by Larry Young paving this Summer
Richard Byrd informed the Council about the streets that will be repaired this Summer. Council member Dale Kovacs moved to approve the streets to be repaired by Larry Young Paving. Seconded by Council member Chris McGilbra. With each Council member voting AYE motion carried.
(d.) Discuss and approval of payments to Weisinger for the new well #6 for the total of $179,396.00
Mayor Pro Tem Russell Bailey moved to approve payments to Weisinger for the new well #6 for the total of $179,396.00. Seconded by Council member Chris McGilbra with each Council member voting AYE motion carried
(e.) Discuss and possibly award the construction contract for the 2017 TXCDBG Hwy 21 Sanitary Sewer improvements Project
William Huebner project manager from Strand Associates spoke to the Council about this project.
Mayor Pro Tem Russell Bailey moved to approve the award construction contract to Horseshoe construction for the 2017 TXCDBG Hwy 21 Sanitary Sewer improvements project Seconded by Council member Lois Brown with each Council member voting AYE motion carried
(f.) Discuss and possible approve an inter-local cooperation agreement between The City of Midway, Texas and The City of Madisonville, Texas
Chief mentioned an agreement with the City of Midway for off-duty Madisonville police officers to work as a patrol officers in Midway. The work schedule encompasses one day a week for four hours chosen at randomly.
Motion was made by Council member Lois Brown to approve an inter-local cooperation agreement between the City of Midway and the city of Madisonville. Seconded by Mayor Pro Tem Russell Bailey with each Council member voting AYE motion carried
(g.) Discuss and possible approval on an Ordinance 809 of the City of Madisonville Texas over Garage Sales
Don Grooms spoke to the Council about Ordinance 809. The City now will require all residents holding a garage sale have a permit at a fee of $5. Additionally, all residents will be allowed only two sales per year, and each sale can last no more than 72 hours. The
Ordinance also limits signs for individual garage sale: one for the site of the sale and two elsewhere. The additional signs cannot be on city traffic signs or utility poles, and can only be placed on other properties with that owner’s permission. Signs can be no longer than 2
square feet, and must be removed within 24 hours after the sale concludes. City Attorney stated that we needed to add the following wording on the Ordinance “paying his/her City of Madisonville Garage Sale Permit in an amount to be established by approval of the City
Council of the City of Madisonville Texas., Motion was made by Council member Dale Kovacs to approve an Ordinance 809 with the additional wording. Seconded by Mayor Pro Tem Russell Bailey with each Council member voting AYE motion carried
(h.) Discuss and possible approval on an Ordinance 810 providing that Ordinance 112 of the City of Madisonville be amended by adding Material Standards for Access Surface
Council discussed Ordinance 810. After a long discussion, Council decided to postpone this item. Motion was made by Mayor Pro Tem Russell Bailey Seconded by Council member Dale Kovacs with each Council member voting AYE motion carried
(i.) Discuss and possible approving on waiving city taxes for EDC in the amount of $8.12
Council member Lois Brown moved to approve on waiving city taxes for EDC in the amount of $8.12 Seconded by Mayor Pro Tem Russell Bailey with each Council member voting AYE motion carried.
