The Madisonville City Council met in a regular council meeting on August 13, 2018 at 6:00 p.m. at 210 W. Cottonwood, Madisonville, Texas

I. Mayor Bill Parten called the meeting to order at 6:00 p.m.
II. Invocation was given by Pastor Ed Collin
III. Mayor Pro Tem Russell Bailey led the Pledge of Allegiance to the American Flag and the Texas Flag with Mayor Bill Parten and City
Council, staff members and visitors
IV. VISITORS FORUM (3 MINUTES) Pastor Ed Collins thank the Council for attending community vigil prayer. Billy Rigby, Harper’s son-in-law addressed the council, saying the council member takes care of his family, and was a man of character and a man of faith. “Words have been spoken and written that were hurtful, were defamatory.” Mr. Rigby said. “They caused irreparable hurt in our family. but, this will not shake our faith. We love our father, our father-in-law and we love our papaw

V. CONSENT AGENDA

All consent agenda items are considered to be routine by the City Council and will be enacted by a motion. There will be no separate discussion on these items unless a Council Member so request, in which event the item will be removed from the Consent Agenda and considered in its normal position on the agenda.

(A.) Approval of the minutes as written for July 9, 2018, July 23, 2018, July 30, 2018 and August 7, 2018
Council member Dale Kovacs moved to approve the minutes as written. Seconded by Councilm ember Jerry Harper with each Council member voted AYE motion carried
(B.) Approval of Accounts Payable as written for the previous month
Mayor Pro Tem Russell Bailey moved to approve the Accounts Payable as written. Seconded by Council member Lois Brown with each Council member voting AYE motion carried
(C.) Follow up report of Council request involving citizen complaint of Terri Davis at Lake Madison Park made July 9, 2018 at regular council meeting (by Chief of Police H.G.)
At the July Council meeting, Terry and Harry Davis had claimed that Council member Jerry Harper and Dale Kovacs were “inappropriate” in their attention to the family while the Davises’ were at the Lake Madison Park fishing and picnicking. Mayor Bill Parten asked that the matter be investigated. Chief Herbert Gilbert said Monday during the Council meeting that there was no proof to the allegations that Harper was taking photos of the family; in fact, Davis told police she did not know if the council member had a camera or not. Chief Gilbert also said that there is no law against taking photographs at the park. Additionally, it was found that Kovacs was not at the park during the incident at all. Chief Gilbert also stated that any resident of the community that has similar issues should pproach the proper authorities and the matter will be handled appropriately.
(D.) Discuss and consider approving Ordinance 723-B of the City of Madisonville establishing a curfew for certain juveniles; providing for definitions; providing for exceptions; providing for enforcement; providing for penalties; providing for severability; providing a savings clause; providing for effective date.
Mayor Parten stated that this Ordinance needs to be adopted every three (3) Years. Mayor Pro Tem Russell Bailey moved to approve Ordinance 723-B establishing a curfew for certain juveniles. Seconded by Council member Dale Kovacs with each Council member voting AYE motion carried
(E.) Discussion and possible approval on a Resolution 92-2018 authorizing application with the Texas Parks & Wildlife Department for the purpose of participating in the Local Park Grant Program
Council member Lois Brown moved to approve on a Resolution 92-2018 authorizing application with the Texas Parks & Wildlife department Seconded by Mayor Pro Tem Russell Bailey with each Council member voting AYE motion carried
(F.) Discussion and possible approval on Applicant’s Certification & Program Assurances for the Local Park Grant Program
Mayor Pro Tem Russell Bailey moved to approve on applicant’s certification & Program Assurances for the Local Park Grant program Seconded by Council member Lois Brown with each Council member Lois Brown with each Council member voting AYE motion carried
(G.) Discussion on current Investment Policy
Council member Harper mentioned that during his term investments have been handled rather poorly, but no action was taken.
