The Madisonville City Council met in a regular council meeting on October 9, 2018 at 6:00 p.m. at 210 W. Cottonwood, Madisonville, Texas

Meeting called to order at 6:00 p.m.

I. Mayor Bill Parten called the meeting to order at 6:00 p.m.
II. Invocation was given by Mayor Pro Tem Russell Bailey
III. Mayor Pro Tem Russell Bailey led the Pledge of Allegiance to the American Flag and the Texas Flag with Mayor Bill Parten and City
Council, staff members and visitors

V. CONSENT AGENDA
All consent agenda items are considered to be routine by the City Council and will be enacted by a motion. There will be no separate discussion on these items unless a Council Member so request, in which event the item will be removed from the Consent Agenda and considered in its normal position on the agenda.
(A.) Approval of the minutes as written for August 13, 2018
Council member Jerry Harper moved to approve the minutes as written. Seconded by Mayor Pro Tem Russell Bailey with each Council member voted AYE motion carried
(B.) Approval of Accounts Payable as written for the previous month
Mayor Pro Tem Russell Bailey moved to approve the Accounts Payable as written. Seconded by Council member Dale Kovacs with each Council member voting AYE motion carried

(D.) Discuss and possible approval of Resolution 98-2018 regarding a contract for the purpose of Financing Police Vehicles
Chief mentioned to the Council that the Police Department will be getting A K-9 vehicle and a vehicle for the Detective Officer.
Mayor Pro Tem Russell Bailey moved to approve Resolution 98-2018 regarding A contract for the purpose of financing Police Vehicles. Seconded by Council member Dale Kovacs with each Council member voting AYE motion Carried
(C.) Discuss and possible approval of Resolution 97-2018 Nationwide Retirement Solutions deferred compensation program
Chuck Conn, from Nationwide Retirement Solutions briefly explain to the Council about the retirement system for all the City Employees.
Mayor Pro Tem Russell Bailey moved to approve Resolution 97-2018 Nationwide Retirement Solutions, Seconded by Council member Jerry Harper with each Council member voting AYE motion carried
(E.) Discuss and possible approval of Madison County Appraisal District Budget for the fiscal year 2019
Mayor Pro Tem Russell Bailey move to approve of Madison County Appraisal District Budget for the fiscal year 2019. Seconded by Council member Dale Kovacs with each Council member voting AYE motion carried
(F.) Discuss and possible approval of Ordinance 813 providing that Ordinance 642 of the City of Madisonville be amended by adding regulations by type of sign of off-premise temporary signs and Ordinance 809 Garage Sales be amended on General Permitted Standards
Don Grooms, briefly explain to the council about off-premise commercial signs after a long discussion council directed staff to add permit fees, fine fees and the number of signs permitted, council will come back to this ordinance later in the meeting.
(G.) Discuss and possible approval of Ordinance 814 the amendment of certain Ordinance no’s 373, 427, 498 and 797 of the City of Madisonville establishing rules and regulations for the users of Lake Madison Park and Marian
Anderson Park; providing for enforcement; providing for penalties; providing for severability; providing a saving clause; providing a repealing clause; and providing for an effective date an including a penalty provision
Don Grooms briefly explain to the Council about Ordinance 814 about “No Wake” zone at the City Park.
Mayor Pro Tem Russell Bailey move to approve Ordinance 814 establishing rules and regulations for the users of Lake Madison Park and Marion Anderson Park. Seconded by Council member Jerry Harper With each Council member voting AYE motion carried
(H.) Discuss and possible approval from Carrinton Mortgage requesting a refund for erroneous payments made to the wrong account. The accounts paid were in the name of JB Burns Jr. instead of JB Burns Sr. in the amount of $1808.12
Council member Lois Brown move to approve a refund Carrinton mortgage for erroneous payments made to the wrong account. Seconded by Mayor Pro Tem Russell Bailey with each Council member voting AYE motion carried

The City Council may enter into closed Executive Session to discuss the following matters:
• Pursuant to 551.07 wit: City Manager, Camilla Viator- to discuss and approval of City Manger’s contract Council member Jerry Harper moved to go into Closed Executive Session at 7:00 p.m. Seconded by Mayor Pro Tem Russell Bailey with each Council member voting AYE motion carried

RECONVENE TO OPEN SESSION:

Mayor Pro Tem Russell Bailey moved to go back into open session at 7:10 p.m. Seconded by Council member Lois Brown with each Council member voting AYE motion carried.
• Pursuant to 551.07 wit: City Manager, Camilla Viator- to discuss and approval of City Manger’s contract
Council member Dale Kovacs moved accept the City Manager’s 3 year Contract. Seconded by Mayor Pro Tem Russell Bailey with each Council member voting AYE motion carried.

Don Grooms, mentioned to Council about the updates on the Ordinance 813 Mayor Pro Tem Russell Bailey moved on approval of Ordinance 813 by adding Regulations by type of sign of off-premise temporary signs and on General Permitted Standard. Seconded by Council member Jerry Harper
